Real Property Solutions, LLC (“RPS, LLC”) operates https://timelycontract.com (the “Site”). This page informs you of our terms and conditions of use for this site, and policies regarding the collection, use, and disclosure of Personal Information we receive from users of this Site.  By using this Site, you agree to our terms and conditions of use, and our collection and use of information in accordance with these policies.

Our site allows you to create a No-charge Attorney Consultation Request by briefly describing your legal needs regarding a residential real estate purchase and sale transaction in the State and County where the property is located. Your No-charge Attorney Consultation Request is then referred to a TC Certified® real estate attorney licensed in the State where the property is located. That attorney is independent and separate from RPS, LLC and is not our employee, partner, or joint venturer. RPS, LLC does not control the attorney’s work and we do not share our profits or losses with them. Attorneys in our network pay RPS, LLC a one-time referral fee upon their receipt for each of your No-charge Attorney Consultation Request(s). Your relationship with that attorney is a matter of contract between you and that attorney, and RPS, LLC is not a party to that contract or a third-party beneficiary of it. Users of our site pay nothing to RPS, LLC for the referral to the attorney. TC Certified® attorneys have been qualified by RPS, LLC to have certain qualifications to become TC Certified®, see below, but RPS, LLC cannot and does not certify or guarantee any results of your use of them to reach your goals.

We Are Not Lawyers

RPS, LLC is not a law firm and does not give legal, business or tax advice. None of our representatives are lawyers and they also do not provide legal, business or tax advice. Our site is not a substitute for the advice or services of an attorney licensed in the State, County, Parish, federal enclave, or Indian reservation where the property is located. If RPS, LLC has a TC Certified® attorney in the jurisdiction where your property is located, we will refer your legal concerns about your transaction to him or her for legal, business or tax advice.

This Site Does Not Give Legal Advice

The law is different from State to State, and may be subject to differing interpretations by different courts. The application of law to specific facts is a unique and personal matter, and no general information found on this website can give you actionable and reliable advice. Any information contained on this site is not legal advice and is not guaranteed to be correct or up to date. Therefore, you should consult a licensed attorney in your State through our referral service. Our site does not intend to create any attorney-client relationship, and your use of our site does not and will not in any circumstance create an attorney-client relationship between you and us. We are only a lawyer referral service. By referring you to an independent attorney, we hope to give you the chance to avoid costly mistakes resulting from a real estate purchase and sale contract.

Our TC Certified Attorney Network

Our site is only one source of an attorney among many sources that are available to you. You may wish to consider multiple sources when making an attorney selection decision. RPS, LLC cannot make any guarantee that the attorney referral we provide you will suffice to meet your specific goals for your real estate transaction. Each attorney in our network of TC Certified attorneys has certified to us that they have at least five (5) years’ legal practice and experience in the State where they are licensed in the following six (6) areas:

  1. Residential real estate purchase and sale agreements,
  2. Auxiliary real estate agreements such as water/sewer/road agreements,
  3. Deeds,
  4. Easements,
  5. Land use law, and
  6. Owner title-related research.

After you initiate your No-charge Attorney Consultation Request, you remain solely responsible to decide whether the attorney we refer you to is suitable for your purposes of your unique real estate transaction. The attorney we refer you to may or may not be the correct legal counsel for you. Any agreements regarding legal services or fees are done outside of our site and are strictly between the you and the independent attorney and do not involve us in any way. We do not receive any portion of any attorney’s or law firm’s fees from your contract with him or her. Upon receipt of your No-charge Attorney Consultation Request, that attorney pays us a referral fee for the privilege of receiving our referral from you. After that No-charge Attorney Consultation Request is sent to the TC Certified Attorney, RPS, LLC is not involved in or responsible for any transactions that might occur between you and any attorney or third party, and we do not guarantee that such transactions will occur, or, if they do occur, that the outcomes will be satisfactory to you. You also should be aware that States and jurisdictions such as tribal lands have special rules relating to provisioning of legal services. You should contact the State or local jurisdiction where the real property is located for more information, or request your TC Certified attorney include such information in the scope of service for the contract between you and your TC Certified attorney.

No Guarantees or Warranty

For your unique transaction, we make no representation, guarantee or warranty (express or implied) as to the legal ability, competence, quality, or reliability of any legal services you may be provided through our referral service. The purpose of the Timely Contract system is to narrow the field of attorneys available to you during the time-constricted calendar of your real estate transaction. Other attorneys may be available to you, and you remain free to do your own research, however, only TC Certified attorneys have agreed to provide their assistance to you under the time constraints of a real estate transaction. Prior to inclusion in our listings, we confirm a lawyer’s status with the applicable State Bar; however, we do not perform ongoing reviews of a lawyer’s status and we do not and have not investigated or vetted the qualifications, experience, or other matters related to the lawyers, law firms, or any legal services, except as stated above. You must independently verify to your satisfaction the qualifications of any such legal professionals and services.

Further, our selection of a participating lawyer or law firm as a recipient of your No-charge Attorney Consultation Request is not based on our analysis of your potential legal problem or our assessment of the ability of the attorney receiving the No-charge Attorney Consultation Request to resolve your specific legal concern. RPS, LLC cannot and will not perform a check for conflicts of interest between you and an attorney or other parties to your residential real estate transaction.

Use Of Your Personal Information

When creating your No-charge Attorney Consultation Request, you will be required to provide Personal Information such as your name, address, email address, telephone number, and State and County or Parish where the property is located. After transmitting your No-charge Attorney Consultation Request to an attorney in the property’s jurisdiction, RPS, LLC does not retain that information, nor do we retain a copy of the documents you are required to upload for the attorney’s use. Please ask the attorney who contacts you as a result of your No-charge Attorney Consultation Request for information regarding his or her privacy practices related to your Personal Information. The only information RPS, LLC keeps is your name, the date of the referral, and the jurisdiction of the property; all used for our analytics only, and not for any third parties.

We will not use your Personal Information to contact you with newsletters, marketing, or any type of electronic material. The Personal Information we collect is passed on to the attorney who may assist with your real property transaction, and safeguarding it is his or her duty to you under the provisions of that attorney’s privacy policy and fee agreement with you.

Limit On Damages

If you create and have us transmit a No-charge Attorney Consultation Request, you agree that: IN NO EVENT WILL RPS, LLC BE LIABLE FOR DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, (A) LOST PROFITS OR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE NO-CHARGE ATTORNEY CONSULTATION REQUEST REFERRAL SERVICES, OR (B) FOR ANY ADVICE, INFORMATION OR SERVICES PROVIDED TO YOU BY ANY TC CERTIFIED ATTORNEY WHO CONTACTS YOU AFTER RECEIVING YOUR NO-CHARGE ATTORNEY CONSULTATION REQUEST, OR (C) FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE REAL ESTATE PURCHASE AND SALE AGREEMENT WITH WHICH YOU ARE CONNECTED AS A PARTY OR IN ANY OTHER CAPACITY. TO THE EXTENT THE FOREGOING LIMITATION OF LIABILITY IS LIMITED OR PROHIBITED, OUR SOLE OBLIGATION TO YOU FOR DAMAGES WILL BE LIMITED TO $100.00.

Our Specific Disclaimers

State attorney licensing requirements differ, and you acknowledge that RPS, LLC makes certain disclaimers about the TC Certified Attorneys who receive your No-charge Attorney Consultation Request:

  • No representation is made that the quality of the legal services to be performed by TC Certified attorneys is greater than the quality of legal services performed by other lawyers.
  • No representation is made that the TC Certified attorney who receives your No-charge Attorney Consultation Request may be considered to be a specialist or who may hold a State-certification as a specialist in the area of residential real estate transactions.
  • No representation is made regarding the quality of legal services that have been or will be performed by a TC Certified attorney.
  • Past results by a TC Certified attorney afford no guarantee of future results; each matter is different and must be handled and judged on its own unique merits.
  • The choice and hiring of a TC Certified lawyer is an important decision and should not be based solely upon advertisements, internet reviews, or our referral to a given TC Certified attorney.
  • No representation is made regarding the qualifications of TC Certified lawyers, except for the attorney’s representation that they have a minimum of five (5) years’ experience in real property law when applying to be a TC Certified Attorney.
  • Being included in our TC Certified attorney network requires no payment to us by those attorneys, and the selection of a TC Certified lawyer to receive No-charge Attorney Consultation Request is the result of the representations of the attorney and involves no evaluative judgment about their work or expertise by us. When a TC Certified attorney is included in our referral network, it does not mean that lawyer is the “best” or “right” lawyer for your needs or that the TC Certified lawyer is otherwise to be preferred over other lawyers.
  • TC Certified attorneys willing to contact you with your permission as a response to your No-charge Attorney Consultation Request pay a referral fee to us that is separate from any fees you may pay them if you decide to hire them after your initial call in response to the No-charge Attorney Consultation Request.
  • States have varying requirements for certification of lawyers as specialists or experts. We do not check on the existence of any special certifications for any attorney in our network. You must do your own research to determine whether any attorney may be able to meet your needs.
  • Any customer review on this website does not constitute a guarantee, warranty, or prediction regarding the outcome of your legal matter.
  • Anyone considering hiring a lawyer should independently investigate the lawyer’s credentials and ability, and not rely upon advertisements or self-proclaimed expertise. RPS, LLC has narrowed the field of available real estate attorneys for you as a service when you are under time pressure. Your real estate transaction calendar should control the attorney’s provision of advice and opinions given to you, so that your transaction can remain on track to close escrow with minimal or no interruption. It is your obligation to make sure your attorney has the information he or she needs to stay within your transaction calendar.

Telephone Recordings

RPS, LLC recommends, but does not require that attorneys receiving No-charge Attorney Consultation Request record all telephone calls with you. Voice recording of conversations may be regulated by both the State where you are located as well as the State where the attorney is located. Giving notice of whether a call is being recorded should be given by the attorney, and in many States your consent is required. We recommend you approve of call recording, because the speed of a residential real estate transaction, the tight contract calendars, and the detailed nature of legal concerns related to those transactions should be available for your attorney by later review of those recordings to assure the most accurate counsel. We also suggest, but do not require, that TC Certified attorneys provide you with copies of those recordings.

Cookies

Cookies are files with small amounts of data, which may include an anonymous and unique identifier. Cookies are sent to your browser and stored on your computer’s hard drive. Like many sites, we use “cookies” to collect information. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Site.

Log Data

Like many site operators, we collect information sent by your browser when you visit the Site (“Log Data”). This Log Data may include information like your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Site that you visit, the time and date of your visit, the time spent on those pages and other statistics. In addition, we may use third party services, such as Google Analytics, that collect, monitor and analyze this information. The Log Data is used for analytics or tracking services by websites and/or apps and is used only in the aggregate with other users’ Log Data and does not include Personal Information you supply to us as a part of your Attorney Consultation Request.

Security

Although we take reasonable security measures to keep your Personal Information private, no method of transmission is 100% secure. While we strive to stay current with commercial security standards, we cannot guarantee the security of your Personal Information.

Ownership

The site is owned and operated by RPS, LLC. All right, title and interest in and to the materials provided on the site, and to the processes used within it, including but not limited to information, documents, logos, graphics, sounds and images (the “Materials”) are owned either by us or by our respective third party authors, developers, or vendors (“Third Party Providers”). Except as expressly allowed by us in writing, none of the Materials may be copied, reproduced, republished, downloaded, uploaded, posted, displayed, transmitted, or distributed in any way and nothing on this site shall be construed to confer any license to you or anyone to use our intellectual property rights, whether by estoppel, implication, or otherwise. We do not sell, license, lease, or otherwise provide any of the Materials other than those specifically identified as being provided by us. Any rights not expressly granted herein are reserved by us.

Changes To This Privacy Policy

If material changes are made to this Privacy Policy, notification will be found on this page. Check this page periodically for changes. Your use of this website after a change is posted constitutes your acknowledgment of the changes and your consent to abide by and be bound by the modified Privacy Policy.
