What is Timely Contract® and

How Does it Work?

Timely Contract® connects homebuyers and sellers to experienced real estate attorneys fast

If you are experiencing problems with the following:

Land Documents

Land documents affect your use of a property. They are sometimes referred to as “invisible risks” because you can’t always see the risks they represent:

  • Covenants, Conditions & Restrictions (CC&Rs)
  • Deeds
  • Easements
  • Judgments
  • Plats
  • Records of Surveys
  • Road Agreements
  • Septic Agreements
  • Tax Liens
  • Water Agreements
  • Building permits
  • Chain of title
  • Conservation restrictions
  • Endangered species
  • Environmental phase testing results
  • Flood zones
  • Grazing permits
  • Pre-existing code violations
  • Septic permits
  • Timber tax exemptions
  • Tribal laws or regulations
  • Water rights
  • Wetlands
  • Zoning … and more

Purchase and Sale Agreements (PSA's)

Off-the-shelf PSA’s and associated documents don’t always address the unique needs of buyers or sellers or the idiosyncrasies of a property. The following list are examples of common problems:

  • Ambiguous contract language
  • Poor or incorrect legal description
  • Misspelled or incorrect name for title grantor
  • Lack of consideration for exchange
  • Lack of easement use provisions
  • Poorly drafted easement use terms
  • Poorly drafted party communications method
  • No reference to modification in contract
  • Poorly drafted contract modification provision
  • No termination provisions for encroachment
  • More than one date, except for signatures
  • No deadline(s) for performance
  • No dispute resolution language
  • Onerous default provision
  • One-sided indemnification provision
  • Use of fence for property boundary … and more

TC Certified® attorneys can help!

How it Works

1

Free Initial Attorney Call(s)

Select up to three TC Certified attorneys. The attorneys will reach out within two business days. Discuss your legal concern with each of them. To receive legal advice, you will need to engage the attorney you’re most comfortable working with.

But what if an attorney doesn’t call?

In the unlikely event one attorney doesn’t reach out, it’s even more unlikely that the other two selected attorneys will likewise not reach out.

2

Engage an attorney

Engage the attorney you’re comfortable working with by returning their signed Fee Agreement and paying the advance fee.

But what if I can’t afford an attorney?

Legal problems don’t get less expensive after the close of escrow. Timely Contract’s legal solutions cost pennies on the dollar before the close of escrow compared to unreliable court remedies after the close.

3

Legal deliverable

In most instances, you’ll be emailed your legal deliverable 4 to 10 business days after all necessary documents have been received by the attorney.

But what if I miss a contract deadline?

If your deliverable due-by date takes you outside of a contract deadline, the TC Certified attorney will inform you during the Initial Attorney Call. Discuss the possibility of getting the contract deadline extended.
